Terms of Use

The rules, stated plainly

These terms govern use of the Deft Swaphaldine site and services. The site is an information and marketing platform: transactions in financial instruments execute with the corresponding licensed entity. Using the site means accepting the current version of this document.

1. Use of the site and services

The site provides information, tools and access to an automated trading platform, and both browsing and registering require you to be over 18 and legally capable of financial commitments. Accounts are personal, each user answering for their credentials, with true, current details part of the arrangement.

2. Restrictions

The services serve their stated purpose: trading your own funds, consulting information and using support, while operating for third parties unauthorised, reselling access commercially or degrading availability for others is off-limits.

3. Marketing and newsletters

Operational account emails are part of the service, promotional sends need your consent and carry one-click unsubscribe without affecting anything else.

4. Intellectual property

Brand, logo, texts, design, code and materials belong to Deft Swaphaldine or its licensors, and reproduction, distribution or modification without written permission is barred, saving lawful personal use, a licence to use never being a transfer of ownership. Feedback and ideas you send carry a non-exclusive, royalty-free licence for improving the service, covering ideas rather than your identity, with your personal information following the Privacy Policy as everywhere else.

5. Confidentiality

Personal information follows the Privacy Policy, while anything shared with you in confidence, API keys, configurations, internal documentation, stays secret and never travels to third parties.

6. Links

Third-party links are convenience without endorsement: content, policies and availability off-site are beyond our control and you visit at your own responsibility. Embedded market data or images fetched from external servers necessarily expose your IP to those servers as part of delivery, standard web behaviour listed here for completeness.

7. Prohibited use

  • Breaking laws, AML rules included.
  • Spam, chains or unsolicited bulk messaging.
  • Attacking infrastructure: intrusion, deliberate overload, unauthorised scanning.
  • Infringing others' IP, content cloning included.
  • Registering on false or third-party identity.

Breach may suspend or close the account and trigger the applicable legal steps.

8. Support

Official channel: [email protected], Monday to Friday, 9:00am to 5:30pm AEST (excluding public holidays), with official communication coming only from our domains and never requesting passwords or codes, the queue running in arrival order with security incidents first.

9. Warranties

Services arrive "as is" and "as available": no warranty of profit, performance or uninterrupted operation, published content being general information rather than personal financial advice, with market risk laid out in the risk disclosure.

10. Limitation of liability

To the fullest legal extent, Deft Swaphaldine is not liable for indirect damage, lost profit or losses from investment decisions based on site content, and where liability survives it caps at amounts actually paid in the twelve months before the event. Equally explicit about what the cap never touches: obligations to return available balance and statutory privacy duties, which no terms of use may waive, survive everything else here regardless of reading order.

11. Indemnity

You indemnify Deft Swaphaldine against third-party claims born of your breach of these

On the relationship between these terms and Australian consumer law more generally: nothing here attempts to exclude any guarantee or right that statute provides, and where a court finds any clause overreaches, the clause falls alone while the remainder stands, which is the standard severability position stated in ordinary words.

terms, prohibited account use or violation of others' rights, within what the law allows.

Final provisions

Australian law governs, an invalid clause leaves the rest intact, and forbearance is not waiver. Updates take effect on publication with material changes notified to registered users, executed transactions staying under the version in force at their time, and the published version being the applicable one, so keep a copy. Where these terms meet the rest of the site, support pages, policies and FAQ entries explain particular topics in more depth and those explanations fill this document's gaps rather than competing with it, contradictions resolving in favour of the text closest to the subject. Drafting intent declared: this

A practical note on service changes more broadly: material changes to how the platform operates are announced in advance through the dashboard and the weekly report, with a reasonable window before they take effect, so continuity of your trading is never hostage to a silent update.
